Occupational Health and Safety Compliance and Enforcement Review
Update: Discussion Paper released – 20 June 2016
The panel conducting the review into occupational health and safety (OHS) compliance and enforcement in Victoria has today released a discussion paper for public comment. The discussion paper explores key areas such as: communication and engagement with stakeholders; provision of OHS advice and guidance; and enforcement measures. Comment in response to the questions in the discussion paper can be made on the review website until 1 August 2016. The review panel will consider all feedback received during the public comment process and develop a final report for government. That report will outline recommendations to strengthen OHS standards across the state.
WorkSafe Victoria welcomes the review and is very keen to implement any measures that can improve our performance as an OHS regulator.
In its 2014 election platform, the Victorian Government committed to conduct a review of the effectiveness of WorkSafe Victoria's (WorkSafe) regulation and enforcement of occupational health and safety to ensure a high safety standard in Victorian workplaces.
The Minister for Finance has established the Occupational Health and Safety Compliance and Enforcement Review (OHS Review) to review WorkSafe's compliance and enforcement activities; its provision of OHS compliance information; and promotion of OHS awareness, education and training. The review will make recommendations on appropriate reforms to improve health and safety outcomes for Victorian workers.
Dr Claire Noone has been appointed as the Chair of the Review, and will lead a panel which will comprise Ms Margaret Donnan and Ms Cathy Butcher as its members. The Chair will also be supported by a Secretariat in undertaking this work.
Terms of reference
1. In establishing the Review, the Minister has set the following Terms of Reference:
1.1. To examine, review and make recommendations in relation to the relevance and appropriateness of WorkSafe's Compliance and Enforcement Policy.
1.2. To examine, review and make recommendations in relation to the appropriateness and effectiveness of WorkSafe's compliance and enforcement activities.
1.3. To examine and make recommendations in relation to alignment of WorkSafe's Compliance and Enforcement Policy with the National Compliance and Enforcement Policy.
1.4. To examine, review and make recommendations on WorkSafe's effectiveness in discharging its functions in relation to providing OHS compliance information and promoting OHS awareness, education and training.
The Review will focus on how appropriate and effective are WorkSafe's policies and activities that support its approach to ensuring that OHS laws and standards in Victoria are complied with, enforced and communicated.
A dedicated website will be established to provide the community with access to the Review process and allow them to submit their views on any matters pertaining to the Review.
The Panel will produce a final report for the Minister for Finance by the end of 2016.
