Your legal duties
New regulations for Occupational Health and Safety came into effect on 1 July 2007.
The OHS Regulations outline requirements for the control of risks associated with powered (but not primarily supported by hand) plant. These obligations are addressed in Chapter 3 of the regulations.
The regulations also require people who operate or use high risk plant to be licensed with WorkSafe. In addition, the regulations detail requirements for the registration with WorkSafe of designs of high-risk plant and registration of individual items of some types of plant.
The regulations impose obligations on employers and self-employed persons, employees and designers, manufacturers and suppliers of plant.
Visit the employers, self-employed persons, employees, and designers, manufacturers and suppliers sections of this guide for details of duties relating to plant.
What’s new
Lift safety
The OHS Regulations impose new obligations on employers responsible for lift maintenance. They have the same duties as an employer who has management and control of the lift.
Auctioning of plant
Changed disclosure obligations are imposed on persons who sell plant as an agent of the supplier to ensure purchasers are fully informed about the reliability of the plant they are purchasing.
