Your legal duties
The law requires you to obtain a licence from WorkSafe before undertaking certain workplace activities.
The various requirements for WorkSafe licensing and registration are set out in two sets of legislation:
- Occupational Health & Safety Regulations (includes new High Risk Work licensing)
- Dangerous Goods Regulations (including Road Transport and Explosives)

WorkSafe can suspend or revoke a licence if the activities relating to it are not being carried out safely and competently
Exemptions
Victoria’s Occupational Health and Safety Regulations 2007 are performance based regulations thus they do not prescribe specific ways of complying with the regulations. This provides duty holders with the flexibility to use alternative means to reach the regulations’ outcomes.
