Applying for a review of your premium
If you think your premium, or any penalty that may have been applied to your premium, is incorrect, you can lodge a request for review. To request a review you will need to use the Request for a Review of Premium form.
Where you submit your Request for a Review of Premium form will depend upon the matter you wish to have reviewed. All requests for a review of your premium (that are not as a result of a WorkSafe audit) should be submitted to your WorkSafe Agent. Likewise, a request for review of a late payment or under estimation penalty (or any penalty applied by your WorkSafe Agent), or a request for a review in relation to the estimated future costs of claims should be submitted to your WorkSafe Agent.
If you are requesting a review of the outcome of an audit undertaken by WorkSafe, or of a penalty applied by WorkSafe, the form should be submitted to the WorkSafe Premium Review Branch.
While your request for review is being considered you are still required to pay your premium. Any adjustments to your premium will be made by your WorkSafe Agent at the conclusion of the review.
Requests received from third parties representing employers must include a letter of authority from the employer to act on their behalf.
Timelines
If you think your WorkSafe insurance premium has been calculated incorrectly, your request must be submitted within 60 days of receiving the premium notice from your WorkSafe Agent. WorkSafe can only adjust your premium for the current financial year and the four previous years.
If you wish to request a review of a claim’s estimated future cost, this request must also be made within 60 days of receiving the claims statement from WorkSafe.
If you wish Request for further review of an Agent review decision, where the Agent has formally reviewed the matter, should be lodged with WorkSafe within 28 days of the Agent review decision.
Any request for review will be acknowledged within 10 days and will normally be processed within 90 days from the date it's received by WorkSafe.
What happens during a review
- A premium review officer from WorkSafe may contact you to obtain additional information or to arrange a site visit. It is important that you cooperate with this process.
- The premium review officer may also contact your WorkSafe Agent to obtain information available on their records.
- Once the premium review officer has all the necessary information they will review the request and a decision will be made.
- Although your application for a premium review may be lodged in relation to a specific concern, the premium review will consider all necessary issues in determining if your premium is correctly calculated.
- You will be notified of WorkSafe's decision in writing. A copy of this letter will be sent to your WorkSafe Agent so they can make any necessary premium adjustments.
- If you are not satisfied with the outcome of the review you may decide to seek independent legal advice.
