Common Law application for silica-related conditions

Introduction

A worker is able to notify WorkSafe Victoria of their intention to lodge a Common Law application for a silica-related condition within or outside the 6 year limitation period, and apply for a waiver from WorkSafe to not rely on its Limitations Defence at the time of a Common Law application (subject to the attached policy ‘Common Law time limit policy for workers suffering from silica-related conditions’).
