The sole proprietor of the Carlton site, 160 Leicester Pty Ltd, is charged with breaching Section 26 of the Occupational Health and Safety Act.

It faces one charge of failing to ensure the workplace was safe and without risks to health, by failing to identify material containing asbestos at the site prior to demolition.

A second charge for failing to take appropriate safety precautions in relation to the removal of asbestos before the demolition took place has also been laid.

The charges follow an investigation into the demolition of the hotel, formerly known as the Carlton Inn, in October 2016 and the waste left at the site.

The charges were filed in the Melbourne Magistrates Court. The matter is listed for hearing in August.
