Waste collector charged after worker crushed by truck

A Sunshine North food waste collection company has been charged after a worker was fatally struck by the garbage truck he was operating in a Melbourne laneway in June 2023.

The 26-year-old man had been standing near the garbage truck when it rolled forward and pinned him against a post and building wall in Hosier Lane.

Beyond AG Pty Ltd, trading as Bardee, faces one charge under section 21(1) of the Occupational Health and Safety Act of failing to provide and maintain a safe workplace and one charge under section 23(1) of the OHS Act for failing to ensure people other than workers weren’t exposed to health and safety risks.

WorkSafe alleges the company failed to reduce the risk of injury or death by failing to have in place a system of work which required daily checks of the truck, including the park brake, and the recording and reporting of any identified faults and any encountered while driving; and ensured timely assessment and repair of any faults.

The matter is listed for a filing hearing at Melbourne Magistrates’ Court on Thursday 5 June.

WorkSafe has also charged diesel mechanic Mad Diesel Repairs Pty Ltd in relation to the incident.
