Department charged after Malmsbury assaults

WorkSafe has charged the Department of Justice and Community Safety after a youth justice worker and several occupants were assaulted during an incident at the Malmsbury Youth Justice Centre in October 2023.

The department faces one charge under section 21(1) of the Occupational Health and Safety Act for failing, so far as reasonably practicable, to provide and maintain a safe working environment.

WorkSafe alleges the department breached section 21(2)(a) of the OHS Act by failing to reduce the risk of occupational violence by providing and maintaining a safe system of work to prevent unauthorised access to buildings and security gates.

The department also faces one charge under section 23(1) of the OHS Act for failing to ensure people other than workers weren’t exposed to health and safety risks, so far as reasonably practicable.

The matter is listed for a filing hearing at Kyneton Magistrates’ Court on Monday 25 August 2025.
