Charges after prison officer assault

WorkSafe has charged the Department of Justice and Community Safety following the serious assault of a prison officer at Barwon Prison in February 2022.

The department faces two charges under section 21(1) of the Occupational Health and Safety Act for failing, so far as was reasonably practicable, to provide a safe working environment.

It is alleged the department breached section 21(2)(a) of the OHS Act by failing to provide or maintain a safe system of work for documenting and providing employees access to behavioural information about prisoners they may have contact with.

WorkSafe further alleges the department breached section 21(2)(e) of the OHS Act by failing to provide necessary information or instruction to allow employees to work in a way that was safe and without risks to health.

The matter is listed for a filing hearing at Geelong Magistrates' Court on 23 April 2026.
