Fencing company charged after gate collapse

WorkSafe has charged a fencing company after a steel gate collapsed and fell on a member of the public at an airport hotel in Tullamarine in November 2024, causing serious injury.

Lee Brothers Fencing Pty Ltd faces four charges under section 23(1) of the Occupational Health and Safety Act for failing to ensure that persons other than employees were not exposed to health and safety risks.

WorkSafe alleges the company failed to prepare a documented welding procedure specifying the type, size and method of welds required for the gate; failed to ensure welding works were both carried out and supervised by competent and qualified persons; and failed to ensure the welds were inspected and tested by a qualified welding inspector before the gate was supplied and installed.

The matter is listed for a filing hearing at the Melbourne Magistrates' Court on 6 November 2026.
