Requirements for licences, registrations, permits and certificates of competency (sections 40 & 42)

Employers and self-employed people must not operate their business unless they have the required licences and registrations.

Where a licence or permit is needed for a substance, plant or its design, people must not use the substance or plant in a workplace without the required licence or permits.

Where regulations require a person to have a licence, registration, permit or certificate of competency to carry out work or an activity, it is an offence for them to do that work or activity if they do not hold the required licence, registration, permit or certificate of competency.

It is an offence not to comply with these sections and penalties apply.

Requirements for qualifications, experience and supervision (section 41)

Regulations may require a person to be qualified or have certain experience or be supervised by someone who has these qualifications or experience, for some work or activities. People must not do the work or activities without the required qualifications, experience or supervision.
