Company charged after falling machine part hits worker

WorkSafe has charged a plastics manufacturer after a serious machinery failure at a Laverton North workplace in November 2021.

A & J Australia Pty Ltd is facing two charges under section 23(1) of the Occupational health and Safety Act for failing to ensure persons other than employees were not exposed to health and safety risks.

It is alleged the company failed to provide fixed guarding to prevent access to hazardous moving parts and to protect workers from falling parts or product.

WorkSafe further alleges A & J Australia failed to implement a system of work to ensure machinery was maintained in a safe working condition and that critical components were maintained to manufacturer specifications.

A worker, who was employed by another company, required hospital treatment after part of a machine he was operating fell more than two metres and struck him on the head.

The matter is listed for a filing hearing at Melbourne Magistrates' Court on 6 March 2023.
