Disability support provider charged following death

WorkSafe has charged a provider of supported independent living services after a client died following a seizure at her Eaglehawk home in May 2021.

Amicus Community Services Limited is facing one charge under section 23(1) of the Occupational Health and Safety Act for failing to ensure that people other than employees were not exposed to health and safety risks.

It is alleged the company failed to set monitoring requirements to ensure the client was regularly and directly observed between the hours of 12am and 6am.

Amicus Community Services is also facing a second charge under section 38(1) of the OHS Act for failing to notify WorkSafe immediately after becoming aware of the incident.

The matter is listed for a filing hearing at Bendigo Magistrates' Court on 28 September 2023.
