This policy outlines WorkSafe's approach to claimants' entitlement to legal costs incurred in connection with claims for lump sum compensation following the death of a worker where the amount of compensation is determined by WorkSafe and not by a court.
This policy relates to compensation paid under either s92 or s92A of the Accident Compensation Act 1985 or under Division 8 of Part 5 of the Workplace Injury Rehabilitation and Compensation Act.
