Imminent risk of death impairment claim guidelines

These Guidelines apply to a claim for compensation for non-economic loss (Impairment Benefit) in respect of a worker whose claimed injury or an unrelated medical condition or injury gives rise to an imminent risk of death.

What it contains

These guidelines apply to a claim for impairment benefits made under the Workplace Injury Rehabilitation and Compensation Act 2013 or the Accident Compensation Act 1985, for a worker whose claimed injury or an unrelated medical condition or injury gives rise to an imminent risk of death.

It sets out processes and timeframes for:

  • lodging impairment benefit claims
  • evaluation and assessment of claims
  • settling disputes concerning liability for a claimed injury or assessment of impairment.

These guidelines come into effect on 1 July 2019.
