Indexation of Amounts in the WorkCover (Litigated Claims) Legal Costs Orders

What it contains

The WorkCover (Litigated Claims) Legal Costs Orders apply to Originating Motions issued under S134AB(16)(b) of the Accident Compensation Act 1985 (the ACA) or S335(2)(d) of the Workplace Injury Rehabilitation and Compensation Act 2013 (the WIRCA) for applications made on or after 28 October 2010.

Sections 5 of the LCO 2010 and the LCO 2016 include provisions to allow for annual indexation based on the consumer price index. The rates included in the LCO 2016 continue the indexation variation as applied under the LCO 2010.
