Requests for the authority to commence prosecutions

This report contains requests for prosecutions from a person who considers that an act, matter or thing constitutes an offence against the OHS Act.

Background

Pursuant to section 131 of the Occupational Health and Safety Act 2004 (OHS Act), sections 577 and 607 of the Workplace Injury Rehabilitation and Compensation Act 2013 (WIRC Act), and sections 40A and 28A respectively of the Dangerous Goods Act 1985 (DG Act) and the Equipment (Public Safety) Act 1994 (EPS Act), if a person considers that an act, matter or thing constitutes an offence against the particular Act or associated regulations, and no prosecution has been brought in respect of the act, matter or thing within six months of its occurrence, the person may request in writing that the Authority bring a prosecution. This report is published in the Authority's Annual Report.
